      刘先生后质疑该公司的合法性，要求其出示相关经营许可证，并要求退款。却称公司有营业执照，经营也是合规的，刘先生下的单子都交易到国际盘上面去了，做了国际对冲，与该公司没有关系。后来，刘先生觉得很不对劲就上网查询，咨询到我们，我们提醒刘先生先调取银行流水记录，查阅自己的银行流水，看看每笔交易的入金及出金情况。刘先生去银行调取银行流水后，发现银行的入金是一个第三方支付平台，出金账户是一个私人账户。

我们国家关于外汇、futures的法律

        一、《期货交易管理条例》(2017Annual revision)第四条明确规定“期货交易应当在国务院批准的或者国务院期货监督管理机构批准的其他期货交易场所进行”；第六条规定“未经国务院批准或者国务院期货监督管理机构批准，任何单位或者个人不得设立期货交易场所或者以任何形式组织期货交易及其相关活动”。“外盘期货”交易违反了“应当在国务院批准的或者国务院期货监督管理机构批准的其他期货交易场所进行”的规定。相关代理机构和个人代理“外盘期货”违反了“任何单位或者个人不得设立期货交易场所或者以任何形式组织期货交易及其相关活动”的规定。
          二、《期货交易管理条例》(2017修订)第四条第二款明确规定，“禁止在前款规定的期货交易场所之 外进行期货交易”。“外盘交易”属于在依法设立的期货交易场所之外进行的期货交易，是法律明令禁止的。
          三、《非法金融机构和非法金融业务活动取缔办法》（国务院令1998[247]No18条明确规定“因参与非法金融业务活动受到的损失，由参与者自行承担”。
        四、根据《公安机关办理刑事案件程序规定》：公安机关接受案件后，经审查，认为有犯罪事实需要追究刑事责任，且属于自己管辖的，经县级以上公安机关负责人批准，予以立案;认为没有犯罪事实，或者犯罪事实显著轻微不需要追究刑事责任，或者具有其他依法不追究刑事责任情形的，经县级以上公安机关负责人批准，不予立案。对有控告人的案件，决定不予立案的，公安机关应当制作不予立案通知书，并在三日以内送达控告人。
       也就是说啥呢，境内投资者通过上述机构的交易软件或移动客户端参与境外期货交易，一旦发生纠纷，自身权益将无法得到有效保护。所以在gold外汇市场，这些平台在中国市场是一个灰色地带，徘徊于监管与不监管之间，所以投资者进入黑平台被骗，维权走正常途径是很困难的，出现投资者被骗欲投无门的情况。
