        一、《期货交易管理条例》(2017Annual revision)第四条明确规定“期货交易应当在国务院批准的或者国务院期货监督管理机构批准的其他期货交易场所进行”；第六条规定“未经国务院批准或者国务院期货监督管理机构批准，任何单位或者个人不得设立期货交易场所或者以任何形式组织期货交易及其相关活动”。“外盘期货”交易违反了“应当在国务院批准的或者国务院期货监督管理机构批准的其他期货交易场所进行”的规定。相关代理机构和个人代理“外盘期货”违反了“任何单位或者个人不得设立期货交易场所或者以任何形式组织期货交易及其相关活动”的规定。

          III《非法金融机构和非法金融业务活动取缔办法》（国务院令1998[247]No18条明确规定“因参与非法金融业务活动受到的损失，由参与者自行承担”。
        四、根据《公安机关办理刑事案件程序规定》：公安机关接受案件后，经审查，认为有犯罪事实需要追究刑事责任，且属于自己管辖的，经县级以上公安机关负责人批准，予以立案;认为没有犯罪事实，或者犯罪事实显著轻微不需要追究刑事责任，或者具有其他依法不追究刑事责任情形的，经县级以上公安机关负责人批准，不予立案。对有控告人的案件，决定不予立案的，公安机关应当制作不予立案通知书，并在三日以内送达控告人。
